These Terms & Conditions explain the rules that apply when you browse boscolivo.com or purchase Boscolivo products through our online shop. Please read them before placing an order.

Acceptance and Scope

These Terms & Conditions (the “Terms”) apply to use of boscolivo.com (the “Website”) and to consumer purchases made through the Boscolivo online shop. By placing an order, you confirm that you have read and accept the version of these Terms presented to you at checkout.

If you do not agree, do not place an order. Separate written terms may apply to wholesale, trade or other business-to-business orders and will prevail where expressly agreed. Mandatory consumer law always prevails over any conflicting provision in these Terms.

Consumer
A natural person acting for purposes outside their trade, business, craft or profession.
Customer / you
The person placing an order through the Website.
Products
Goods offered through the online shop, including food, beverages and gift products.

Eligibility, Accurate Information and Alcohol

You must have legal capacity to enter into a binding contract and provide complete, accurate and current billing, delivery and contact information. You are responsible for checking the order details before submission and for keeping any customer-account credentials confidential.

Alcoholic products may be purchased only by persons who have reached the legal purchasing age in both the country of sale and the delivery country. By ordering alcohol, you confirm that you meet that requirement. Boscolivo, its payment providers or the carrier may request age or identity evidence and may refuse the sale or delivery if the requirement is not met.

Responsible purchase: alcohol must not be purchased for a minor. Delivery to some destinations may be unavailable because of local licensing, carrier or import restrictions.

Products, Descriptions and Availability

We take reasonable care to present product names, origin, ingredients, quantity, alcohol content, certifications, photographs and other material information accurately. Packaging, label layout and colour may vary from images where the change does not materially alter the product. Your screen may also display colours differently.

Always read the label, ingredients, allergen information, storage guidance and warnings supplied with the product before use or consumption. If you require information before ordering, contact us. Website content does not replace the information on the physical product label.

All products are subject to availability. Adding an item to the basket does not reserve it. We may set reasonable quantity limits, withdraw a product or correct an obvious description or pricing error before accepting an order. If an unavailable or materially misdescribed product has already been paid for, we will offer an appropriate alternative where agreed or refund the affected amount.

Prices, Taxes and Other Charges

Product prices are those shown on the Website when the order is submitted. Prices include VAT where applicable unless the Website clearly states otherwise. Delivery costs and any other charges collected by Boscolivo are itemised before you place the order.

For deliveries outside the applicable tax territory, the recipient may be responsible for import duties, local taxes, customs-clearance charges or carrier fees that are not collected at checkout. The recipient is also responsible for complying with local import rules. Contact the relevant authorities before ordering if you are unsure.

We may change prices prospectively at any time. A change will not affect an order already accepted, except where correction is required by law or an obvious error makes the displayed price unreasonable and the order has not yet been accepted.

Placing an Order and Contract Formation

  1. Select the products and quantities you wish to purchase.
  2. Review the basket, delivery option, total price and customer details.
  3. Read and accept the Terms presented at checkout.
  4. Click the checkout button that clearly indicates an obligation to pay.

Submitting an order is an offer to purchase. An automated order-received email confirms that we have received the request; it does not by itself mean that the order has been accepted. Unless we expressly tell you otherwise, the sales contract is concluded when we send confirmation that the order has been accepted or dispatched, whichever occurs first.

We may decline or cancel an order before acceptance for legitimate reasons, including product unavailability, an obvious price or description error, failed payment, suspected fraud, quantity limits, legal restrictions, or inability to deliver to the address provided. If payment has already been taken, the relevant amount will be refunded.

We will provide the order information and these Terms in a form that can be stored. Please retain the order confirmation and a copy of the Terms applicable on the purchase date.

Payment

Available payment methods are displayed at checkout and may vary by country, device, currency or order value. Payment services may be supplied by third-party providers such as WooPayments, Stripe or Klarna. Their own terms and privacy notices may also apply.

You confirm that you are authorised to use the chosen payment method and that the payment details are accurate. A provider may authorise, reserve or collect the amount in accordance with the checkout information. Orders may be placed on hold or cancelled if payment is refused, reversed or not completed. Boscolivo does not normally receive or store full card numbers.

Refunds, where due, are normally made to the original payment method. Processing time after issue may depend on the payment provider or bank.

Shipping and Delivery

We deliver only to destinations available at checkout. Shipping methods, charges and available delivery estimates are shown before you submit the order. Full practical information is provided in our Shipping & Delivery Policy, which forms part of these Terms.

Delivery estimates are not guaranteed deadlines unless expressly agreed. We may contact you where an address is incomplete, inaccessible or subject to restrictions. You are responsible for providing an address where the parcel can lawfully be delivered and received, including by an adult where age-restricted goods are included.

For consumer purchases, risk of loss or damage passes when you, or a third party designated by you other than the carrier, takes physical possession of the goods, except where applicable law provides otherwise. If you appoint a carrier not offered by us, different risk rules may apply.

Inspect the parcel promptly. If it is visibly damaged, record the issue with the carrier where possible and contact us with photographs of the parcel, shipping label, internal packaging and affected products.

Order Changes and Cancellation Before Dispatch

Contact info@boscolivo.com as soon as possible if you need to correct or cancel an order. We cannot guarantee a change after the order enters preparation or dispatch. If cancellation is still operationally possible, we will confirm it and arrange any refund due.

If the order can no longer be cancelled, an eligible consumer may still exercise the statutory right of withdrawal described below. Refusing a delivery without contacting us does not necessarily constitute a valid withdrawal and may create avoidable return costs.

EU Consumer Right of Withdrawal

If you are an EU consumer purchasing eligible goods online, you generally have 14 days to withdraw without giving a reason. The period normally begins on the day when you, or a person designated by you other than the carrier, receives the goods. Where one order is delivered separately, the period may begin when the last relevant item or parcel is received.

To exercise the right, send a clear statement before the deadline to info@boscolivo.com or to the postal address in section 2. Include your name, order number, products concerned, order and delivery dates and an unambiguous statement that you are withdrawing. You may also use the model form on our Returns & Refunds Policy.

Exceptions

The statutory withdrawal right does not apply in circumstances excluded by law. Depending on the order, these may include:

  • goods liable to deteriorate or expire rapidly;
  • sealed goods unsuitable for return for health or hygiene reasons once unsealed;
  • goods made to your specifications or clearly personalised;
  • goods inseparably mixed with other items after delivery;
  • specified-date catering, leisure, tasting or event services;
  • services fully performed after your express request and acknowledgement, where the legal requirements are met;
  • other statutory exceptions applicable to the specific product or service.

Opening a bottle or breaking a product seal may affect return eligibility, but it does not remove your rights if the product is defective or not as ordered. Contact us before returning food, beverages, alcohol or personalised products.

Returns, Return Costs and Refunds

After validly notifying us of an eligible withdrawal, return the goods without undue delay and no later than 14 days after the notice. Contact us first so that we can provide the correct return address and instructions. Do not send a parcel to the registered office unless we confirm that it is the appropriate return destination.

For a change-of-mind withdrawal, you normally bear the direct return cost. Pack products securely and keep dispatch evidence. You may be responsible for diminished value caused by handling beyond what is necessary to establish the nature, characteristics and functioning of the goods.

For a valid EU withdrawal, we will reimburse payments covered by the right, including the cost of the least expensive standard delivery option originally offered. Extra costs caused by selecting a more expensive delivery method are not reimbursed unless required by law.

Reimbursement will be made without undue delay and no later than 14 days after we are informed of the withdrawal. We may withhold it until we receive the goods or you provide evidence of having sent them back, whichever occurs first. The original payment method will normally be used without fees from Boscolivo. Damaged, Defective, Unsafe or Incorrect Goods

Your rights concerning defective, damaged or incorrect goods are separate from the withdrawal right. Contact us promptly, quote the order number and provide a clear description and photographs. Retain the product, labels, packaging and batch information until we advise you otherwise.

If a product appears unsafe, leaking, tampered with or otherwise unsuitable for consumption, do not consume or use it. Follow any safety or recall notice and contact us immediately.

Where Boscolivo is legally responsible, the available remedy may include replacement, repair where appropriate, a price reduction, contract termination or refund. We will bear reasonable return costs where required by law. Nothing in this section restricts mandatory remedies.

Legal Guarantee of Conformity

Consumers benefit from the statutory legal guarantee of conformity under applicable law. In the EU, new goods generally carry a minimum two-year legal guarantee from delivery. A product must correspond to its description, be fit for the purposes for which goods of the same type are normally used and have the quality and durability reasonably expected, taking account of its nature and public statements.

The nature of perishable products and any stated shelf life or proper-storage instructions are relevant when assessing conformity. The legal guarantee is not a commercial guarantee and is not excluded by a manufacturer warranty, a return-policy period or these Terms.

Tastings, Visits and Other Services

If the Website offers tastings, visits, catering, events or other services, the description, date, location, participant requirements, included items, price and any specific cancellation terms displayed during booking form part of the contract. Please disclose relevant dietary, accessibility or other practical requirements before booking, although not every request can be met.

Services related to leisure activities or catering on a specific date or during a specific period may be excluded from the statutory withdrawal right. This does not affect rights arising from cancellation or non-performance by Boscolivo or other mandatory law.

Website Use and Intellectual Property

Website text, photographs, graphics, trade names, logos, product presentation and other content are owned by or licensed to Boscolivo and protected by applicable intellectual-property law. You may access and make a personal copy of information reasonably needed to evaluate or document a purchase.

Without prior written permission, you may not reproduce, publish, sell, scrape, systematically extract, alter or commercially exploit Website content; misuse the Website; bypass security; introduce harmful code; interfere with other users; or use Boscolivo branding in a misleading way.

The Website may link to third-party services. Those services are controlled by their operators and are subject to their own terms. A link does not amount to an endorsement unless expressly stated.

Liability

Boscolivo is responsible for loss that is a foreseeable consequence of its breach of contract or failure to use legally required care. To the extent permitted by law, Boscolivo is not responsible for loss caused by inaccurate information supplied by the customer, misuse, failure to follow label or storage instructions, or circumstances for which Boscolivo is not legally responsible.

Products purchased as a consumer are supplied for private use. Separate written terms may apply to business use. Nothing in these Terms excludes or limits liability where exclusion or limitation is prohibited, including liability for fraud, wilful misconduct, gross negligence, death or personal injury caused by negligence, defective products, or breach of mandatory consumer rights.

Events Beyond Reasonable Control

We are not responsible for delay or failure caused by an event beyond our reasonable control, such as extreme weather, natural disaster, fire, epidemic, industrial action, transport disruption, border or customs delay, public-authority action, power or telecommunications failure, or serious supply interruption.

We will take reasonable steps to reduce the impact and inform affected customers. If performance becomes impossible or is significantly delayed, either party may have a right to terminate the affected part of the contract and receive any refund required by law.

Privacy, Cookies and Related Policies

We process personal data to operate the Website, manage payments, fulfil orders, deliver products, handle returns and provide support as described in our privacy information. Non-essential cookies and similar technologies are used only on the legal basis described in the Cookie Policy and, where required, after consent.

Complaints, Applicable Law and Disputes

Please send complaints to info@boscolivo.com, stating the order number and the outcome requested. We will review the matter and aim to respond within a reasonable time.

These Terms and contracts made through the Website are governed by Italian law. If you are a consumer habitually resident in another country, this choice does not deprive you of mandatory protections applicable in that country. Courts have jurisdiction in accordance with mandatory consumer and procedural law, including any consumer right to bring proceedings in the competent court of their domicile.

An eligible consumer may also have access to an independent alternative dispute resolution body. Information about a competent body and any obligation or decision by Boscolivo to participate will be provided where required by applicable law. The parties remain free to seek any remedy available through the courts.

Changes, Severability and Entire Agreement

We may update these Terms prospectively to reflect legal, operational, product or Website changes. The new version applies from the effective date shown at the top and does not retroactively alter an order already accepted, unless a change is required by law or expressly agreed with you.

If any provision is found invalid or unenforceable, the remaining provisions continue in effect to the extent permitted by law. A delay in enforcing a right is not a waiver. These Terms, the order details, the checkout information and the policies expressly incorporated here form the agreement for the online purchase, subject always to mandatory law.

The contractual language is English unless the checkout or order confirmation states otherwise. If a translated version is provided to consumers, any priority between versions must comply with applicable law and the version actually agreed during checkout.
